Sale of landfill Property

To the Powell River Legacy group:

I attended the Catalyst stakeholder meeting last week and was surprised to hear of the company's plans to sell the land the landfill occupies, and then lease it back from the purchaser. My concern is, who then owns the liability for the environmental cleanup of the site should leaks or other problems occur five, ten, or twenty years from now? Is the city of Powell River planing to be the purchaser? Does that make all taxpayers responsible for a future bill that could be very costly? This is the first I've heard of a sale of the landfill site, it has not to my knowledge been talked about, but I think it raises some disturbing questions. Thank you for trying to answer some of them.

These are all good questions which would best be answered by a lawyer.  I am not a lawyer.  The current purchaser we know about is PRSC, of which the city owns one third.   I thought that the owner of a piece of land is responsible for it, and liable for what takes place there.  This would seem to include contaminated lands and I do see the potential for catalyst to shirk its responsibilities.

Sale of landfill Property

Hi all. This is Sarah Barkowski, at the Catalyst mill. I would like to respond to the question regarding the "Sale of Landfill Property".

Please understand that Catalyst Paper has no intentions of selling the landfill property to the City or to PRSC.

Some information which may help clarify the issues follows:

1. All of the active, mini-landfill lies in Block 48. None of this land is for sale.

2. Most of the inactive, asphalt-capped landfill also lies in Block 48. Again, none of this land is for sale.

3. A small, triangular shaped portion of the inactive, asphalt-capped landfill lies in Block 55.

4. Catalyst has submitted an application to the Agricultural Land Commission to remove a parcel of land in Block 55 from the ALR. Should this application be approved, we would be interested in selling part of this block to interested parties, as the land is surplus to Catalyst's needs.

5. However, Catalyst is interested in retaining ownership of the small portion of this parcel that includes the triangular portion of the inactive, asphalt-capped landfill as well as a buffer.

Note: Although the small triangular portion of the inactive, asphalt-capped landfill lies in Block 55, it is not in the ALR.
